These Terms require arbitration on an individual basis for dispute resolution and limit the remedies available to you in a dispute. By continuing to access our Programs, Products, and Services, you acknowledge that you are voluntarily waiving certain legal rights.

1. DEFINITIONS & GENERAL PROVISIONS

“Our,” “we,” and “us” refer to Mystic Gardens Healing LLC (“Company”).
“You” refers to any purchaser, user, or participant in any Program, Product, Service, or Program Material.

These Terms govern all content and offerings made available through our websites, portals, courses, memberships, digital products, and services (collectively “Programs”).

We reserve the right to update these Terms at any time. Continued use constitutes acceptance of any changes.

All Programs are intended solely for individuals age 18 and older.

2. INTELLECTUAL PROPERTY RIGHTS

All content provided by Mystic Gardens Healing LLC—including Program Materials, course content, branding, written materials, videos, graphics, designs, and structures—is owned or licensed by the Company and protected under copyright, trademark, and intellectual property laws.

Your Limited License

When you purchase or access our Programs, you receive a revocable, non-transferable, limited license for personal, non-commercial use only.

You may NOT:

  • Share, sell, reproduce, distribute, or republish Program Materials.

  • Claim our content as your own or create derivative works based on it.

  • Use Program Materials in any business or money-making capacity.

  • Share your login or grant others access to your purchased content.

You may download or print Program Materials for personal use only.

Trademarks

Our trademarks, taglines, and logos may not be used without express written permission.

3. USE OF STUDENT-GENERATED CONTENT

By submitting any content through our Programs—such as comments, posts, images, or videos—you confirm you own the content and grant us permission to display it inside the Program.

You retain ownership of your personal ideas and offerings.
We will not use your own programs, ideas, or proprietary material outside the Program without your permission.

4. IMPORTANT NOTE FOR TEACHERS & CONTRIBUTORS

(This is the small update needed for alignment with your Teacher Addendum)

The following clarifies use of contributor content:

This does not include any of your own ideas, programs, or offerings, except where you have separately granted Mystic Gardens Healing LLC permission in a written agreement (such as a Teacher Agreement or Contributor Addendum) to host, display, or use your content within our Programs. We will not use your ideas, programs, or offerings for any purpose beyond the scope of such written agreement.

This ensures:

  • Students are protected

  • Teachers retain ownership

  • You can legally use teacher-submitted content inside The Frequency

5. MEDIA RELEASE

By participating in Programs that include group calls, Facebook groups, online events, or shared learning spaces, you consent to being photographed or recorded for purposes of providing content to enrolled members.

These recordings will never be sold separately.

6. SECURITY, CONFIDENTIALITY & PRIVACY

We collect personal information such as name, email, billing information, preferences, and other details as needed to operate our Programs.

We take reasonable measures to protect your data, but cannot guarantee absolute security due to the nature of the internet.

7. FACEBOOK GROUPS & COMMUNITY SPACES

If a Program includes a private Facebook group or community space:

  • You understand these platforms are not fully private.

  • You are responsible for your own privacy settings and personal disclosures.

8. PERSONAL RESPONSIBILITY & ASSUMPTION OF RISK

Programs are educational and informational only. No specific outcomes are guaranteed.

You assume full responsibility for your choices, results, and actions related to our content.

9. MEDICAL, LEGAL & FINANCIAL DISCLAIMERS

Our Programs do not provide:

  • Medical advice

  • Mental health treatment

  • Legal advice

  • Financial advice

Always consult appropriate licensed professionals for such matters. We are not liable for any decisions you make based on our content.

10. EARNINGS DISCLAIMER

We do not guarantee:

  • Any particular transformation

11. TECHNOLOGY DISCLAIMER

We do not guarantee uninterrupted access to Programs. Service interruptions may occur due to maintenance, server issues, or other factors.

12. ERRORS, OMISSIONS & THIRD-PARTY LINKS

13. INDEMNIFICATION & LIMITATION OF LIABILITY

You agree to indemnify and hold harmless Mystic Gardens Healing LLC from claims, damages, costs, and expenses arising from:

  • Your use of the Programs

  • Breaches of these Terms

  • Actions of third parties in shared spaces

Our liability is strictly limited to the amount you paid for the Program.

14. CONDUCT EXPECTATIONS

You agree not to engage in behavior that:

  • Harms the Program or community experience

  • Violates laws

  • Disrupts or damages our platforms

  • Impersonates others

  • Harasses members or staff

We reserve the right to remove participants who violate community standards.

15. PAYMENTS, REFUNDS & CHARGEBACKS

By purchasing a Program, you authorize automatic billing where applicable.

We enforce a strict no-refund policy unless otherwise stated.

Chargebacks will result in removal from Programs and may be pursued legally if fraudulent.

16. TERMINATION

We may terminate your access for:

  • Payment issues

  • Breach of these Terms

  • Misconduct

  • Unauthorized use of content

Upon termination, access to materials is revoked.

17. DISPUTE RESOLUTION (ARBITRATION)

All disputes must be resolved through binding arbitration in New York, NY.

Prior to arbitration, you must email us with all concerns for an attempt at informal resolution.

The only remedy available in arbitration is refund of the amount paid.

You waive the right to participate in class actions or public complaints relating to these disputes.

18. GOVERNING LAW

These Terms are governed by the laws of the State of New York.
